The way I read the "fine print" in E-Bays' terms of service, E-Bay has given manufacturers some limited editorial control over E-Bay ad listings.The terms of service are the conditions of use for anyone who uses E-Bay, so any user is deemed to agree to them. Yeah, I know, nobody ever reads that stuff; nobody ever reads the terms of the software license on the software they but, etc. So, one could say its a void "contract of adhesion."
But the reality is, that without such contractual arrangements, the whole web business would break down.
Don't get me wrong; I'm not defending Cooper or McIntosh's heavy-handed approach. One of the lessons that's often missed (and never taught in law school) is that sometimes the best policy is not to attempt to exercise one's legal rights to the fullest. And, I think this was one of those times.
