Based on what you have published, I'd suggest you address Wayne's activity to McIntosh directly. There appears to be no misleading inference that the unit is covered under under any warranty or even that you have a warranty as the purchaser. While Wayne may be given some leeway as too his interpretation of the directions from McIntosh, I would think McIntosh would want to possibly revisit the guidelines and amount of leeway in their interprtations. They should also take responsibility to clear any issues this raised with eBay. If this were my ad, I too would have told Wayne to take a flyer and suggested any communication with eBay could could result in a libel claim against McIntosh and him as their agent. You may also have a cause of action based on tortious interference with a contractual relationship against McIntosh and him as their agent. Remember he acted as Mc's agent and therefore, McIntosh is the movant against you.
