Re: Mcintosh lawyer harassing me - Part 2

What kind of lawyer has as a mandate to check Net sites for auctions of their client's products sold as used? I know that the laws in the US of A are so complex as to be beyond understanding of many lawyers and of the vast majority of the population, but this is strange beyond belief. Would an act such as the one mentioned in this correspondence apply to private parties selling their own property? I see more and more that intellectual property is being defended tooth and nail in the most unlikely ways and contexts possible, but has it come to this? Why this sort of cross-pollination between the content of the advertising and the use of a stock photo that would infringe some intellectual property aspect? The strangest part is to say that misleading advertising by resellers of used products is the reason why McIntosh warranties now only apply to the original purchaser. Surely if anyone who owns a McIntosh product and can show proper evidence of how old the piece of gear actually is benefited from the warranty there would be no need for a witch hunt by a lawyer and the taking of such extreme measures. People keep talking about how long McIntosh has been in business; a more crucial point in explaining this situation could be the changes of ownership over the years. Maybe the new owners are just business people seeking a return and could be selling widgets for all they care. Unless someone at McIntosh speaks his piece and not some lawyer somewhere, I fear that the company's credibility with audiophiles will remain, if not broken, at least bent. If the vendor was trying to pass himself off as an authorized dealer, legal action would be understandable. As it looks though, it seems obvious that the vendor never claimed anything about the warranty and that if a statute does exist forcing a private vendor to say the unit is not covered by the manufacturer’s warranty, it is a sad reflection on the state of things in the USA circa 2004.
