The fallacy in the argument

is that a reasonble E-Bay seller would take away from this description the idea that the product was still covered by the manufacturer's warranty.

Only then would the seller have a duty to disclose.

And, if fact, if Mr. Cooper took his UCC course in law school, he would remember that there are no built-in or implied warranty terms in a transaction that is not between "merchants" (which term does not include an audiophile buying or selling his personal equipment on E-Bay).
