Seems to me that the statement, "The manufacturer's warranty is non-transferable."...

... would be appropriate, but not absolutely required, addition to the ad. It needn't be presented in such a way as to discourage bidders, but only to inform them. A conscientious buyer of such an expensive item should already know this, unless McIntosh is purposely downplaying in their advertising that their warranties are not transferable. The fact that Cooper believes that leaving out the information about the non-transferable warranty is "misleading" clearly demonstrates how unusual and unreasonable McIntosh's warranty policy is. If McIntosh insists on such a policy, each piece of their advertising ought to clearly state in bold print, "WARNING: WARRANTY IS NON-TRANSFERABLE". If not, someone ought to warn Mr. Cooper that he's throwing stones in a glass house.
