I guess I draw a different conclusion

I see this kind of thing not infrequently and it illustrates what I call the "two knunckleheads make a trainwreck" principle.

Knucklehead #1 (obviously): the lawyer representing McIntosh for inventing the idea that an ad for a used product somehow falsely implies that the product is covered by the manufacturer's warranty.

Knucklehead #2: "Ethann" or whatever his moniker his, who refused to include in his E-Bay ad the (true) statement that his slightly used McIntosh amp was not covered by the manufacturer's warranty.

Whatever you do, don't take a trainwreck like this to court. You're unlikely to find much sympathy.
