What is curious is that E-Bay removed the ad not at the request of the seller, but at the request of a 3rd party.

I reckon if the case played itself out, i.e., the seller sold the equipment as advertized, then Mr. Cooper and McIntosh would face a tougher decision - do we go after this guy or not. The answer would be "not," I suppose, because there is nothing false or misleading about the ad.

However, McIntosh clearly finds it in their interest to intimidate McIntosh equipment owners who subsequently wish to sell their equipment. Frankly, this is a very wierd scenario. That they are somehow able to get their tentacles into E-Bay is considerably more disturbing.

I do not know why E-Bay would pull the ad. While no doubt Mr. Cooper threatened them as well, surely E-Bay retains a larger stable of attorneys than McIntosh. Should E-Bay wish to implement such a "warranty disclaimer" in this case, what about the (millions) of other ads which do not contain such a disclaimer?
