The lack of uniformity is an issue

The thing is, Ebay doesn't monitor their listings--people browsing & VERO members do. I suspect that either there's some contentious history between this seller & Mc...or, yes, he was singled out. Doesn't matter. If the listing is in violation of Ebay's TOS, & it was pulled, that's that. You could try lobbying Ebay & pointing out other listings that are in the same violation with regard to VERO rights, but unless it's coming directly from the VERO member, it's not going to accomplish anything.

I don't think Ebay notices too many listings that are not 'kosher' unless someone's selling a body part or something, & even then I'm not sure that they would necessarily be aware of it unless someone points it out to them. I suppose they might have some target words or phrases that'll raise red flags. I know someone who had a listing for a record yanked once because the sound quality on the record was described as 'bootleg-quality.' It was a legitimate release, though, and there was no legal issue with its sale. It'd be nice if what happened with this seller was something that was enforced with everyone else, but if you're going to sell on Ebay, you've got to play by their rules, regardless of whether or not some lawyer is hassling you.
