Interesting way to twist my words...

207.174.27.112

by using selective editing to change my meaning. Kind of reminds me of what the movie studios do when using "quotes" from reviewers to promote their latest awful release.

I'm not so sure that we are disagreeing on what actually happens. In my case the law firms were retained to protect the patent rights of their clients. Inherent in that situation are several mechanisms that result in the law firm over reaching their duties. One of them is financial self-interest as I noted in my previous post. To be fair, another one is that to preserve their patent rights, the IP owner must not be lax about going after actual offenders. These two mechanisms (and others) result in over agressive law firms going after non-offenders.

This current situation is somewhat different in that patent rights are not involved. The law firm was presumably retained on a broad basis to protect the trademark rights of McIntosh. I'm sure that we would agree that they were instructed by McIntosh's management as part of those duties to go after "grey market" dealers. I'm sure that is a real problem for McIntosh, and that the tactic used by the attorney on the original poster would be appropriate in those situations.

But it seems to me that either one of two things has happened:

1) The original poster has misrepresented himself as simply selling his own personal amplifiers, when in fact he is acting as a de facto "grey market" dealer. In this case, the attorney's actions would be warranted in my opinion.

2) The original poster has accurately represented the situation. In this case, I think that the attorney over reached his duties and misunderstood what McIntosh corporate was trying to accomplish.

Based on what has been posted on this thread so far, I would tend to suspect the latter. This is what I said (in a more shorthand way) in my previous post.

Best regards,
Charles Hansen
