Reading between the lines (and noticing the popup on MacIntosh's web site), it appears that MacIntosh is working overtime to block a grey market distribution channel. Given the spread between wholesale and retail, it certainly would be possible for a dealer to sell Mac products at a discount on E-Bay or similar sites and make a profit.

One tool a manufacturer has to prevent this is to withhold warranty service and to make warranties non-transferrable.

Contrary to Dewey's post below, consumer warranty disclosures are now governed by federal law (Magnuson-Moss Warranty Act), and a state law that mandates that warranties be transferred to a second buyer (if such a law exists) may be preempted.

The real issue is not MacIntosh, but the terms of use imposed by E-Bay which appear to permit this sort of editorial control.

I would suggest writing back the Mac lawyer and pointing out to him that your ad makes no representation about a manufacturer's warranty and that you believe the common understanding among purchasers of used audio equipment on E-Bay and similar sites is that, absent an express representation by the seller to the contrary, a used item carries no manufacturer's warranty with it.
