Todd, you could buy a dCS DAC without having any concerns about asynchronous upsampling. This is because none of their DACs (except the new Rossini) offer upsampling. The upsampling takes place in a separate box which you do not need to purchase unless you want it.
Furthermore if you did want to upsample with a dCS sample rate converter then you do not have to to use an asynchronous rate such as 192Ks/s (Kilo samples per second they put it)for 44.1 sources. On offer in the box as well are 88.2 or 176.4 if you are using a 44.1 Ks/s source or 96 and 192 if using a 48 Ks/s one or DSD conversion as well. It is all down to your personal choice, the dCS equipment does not impose anything on you (excepting the Rossini as above).
In fact dCS did not offer any form of upsampling to the home market originally. Some Japanese enthusiasts got hold of one of dCS' studio sample rate converters and reported that they felt it offered an improvement (rate selected unknown). So dCS simply put it into a box that matched the rest of their domestic equipment and offered it to the market.
Personally I dislike any form of sample rate conversion so I am somewhat in agreement with you on the point of principle. However others do like it and I think it is for them to make their choices.
