Tom -Nowhere in the letter you posted is there mention of a lawsuit. Litigation is rarely a good option, usually causing more harm than good. The only exception I've found is policing intellectual property, which must be done or you lose your rights of exclusivity.
In times that lawyers have been involved, I've tended to become publically silent. Frankly, in those times where there has been trademark infringement or other intellectual property issues, the people I've delt with have been more gentlemanly than you have been, even though legal action was a genuine possibility.
The "swan song" thing you did in July looked like a sensationalized attempt for sympathy and self-promotion. See the links below. Please feel free to make public any correspondance between us you wish. Many people have already seen them anyway.
