I'm not sure what the problem is. However it doesn't appear to be related to DRM. See link below which says eMusic specifically decided against DRM -- to make sure their tracks could play on the iPod.
But have you checked your synchronization settings? Are you, perhaps, only synchronizing certain playlists, rather than the whole library?
