Mart, at the risk of driving this matter into the ground, allow me to restate the facts as I know them, and you may judge where responsibilities lie. I have the emails back and forth from Brummel to substantiate what I say.1. Brummel listed the speakers MG10.1 for sale on this site in February 01. I answered the ad, paid my money, and was directed by Brummel to contact Steve Winey at Magnepan to specify how the speakers were to be "dressed" and to give him my shipping information. The speakers were at the factory and were to be shipped from the factory directly to me. I called Magnepan, talked to Steve, and all was confirmed by him to be as Brummel had said.
2. The wait began. I had originally been told by Brummel that shipping would be in about two weeks. When that time had passed I was told by Brummel that Steve had gone out of town without taking care of the speakers. Weeks went by and in further communication Brummel laid the fault for delay entirely with Steve and Magnepan. Magnepan was "not set up to handle this sort of special project," and "Steve is a procrastinator" were the explanations I got. Fine. I know from other posts on this site that Magnepan often takes months to deliver on orders made through dealers, so maybe my matter had a low priority.
3. In the meanwhile I had asked Brummel if any more sets of speakers were available as I had a friend John who was in the market. He said there was, and John sent him his money as well.
4. In August, after waiting six months for the speakers to arrive, John and I decided to cancel our order and ask for our money back. Brummel agreed. No refund was forthcoming. In October we asked for a refund again, and Brummel replied that he would put the checks in the mail "by the end of the week." No refund was forthcoming. In January I contacted Brummel again and requested my refund within a week. When the week passed and no refund had appeared I began my posts on this site.
5. Brummel has repeatedly cited computer crashes as the reason for failing to stay in contact with me. I have resent him John and my addresses five times. His failure to hang onto this information cannot be the simple result of technical malfunction. If he can't be bothered to write the information down on a piece of paper, especially knowing how crash-prone his equipment is, then he must not be taking his commitments too seriously. As for losing my email address, he knows perfectly well that I posted on this site in June and my email address is appended to that post for all to see. If I can find it so can he. He is, after all, running websites for Magnepan and Conrad-Johnson so he must be computer savvy.
6. The actions of an honest man would be a prompt refund of money for non-deliverence of product. Nothing of the sort has come from Brummel to date, even since these posts appeared and my email address is again before the public.
7. I have no wish to slam Magnepan. This whole matter is about as peripheral to their business as it is possible to get. But it is an undeniable fact that I was promised speakers by the president of the company, and did not receive them after a six month wait. That Steve was not acting for the company I accept. That Brummel has not refunded our money is not their legal responsibility I also accept.
But there are other verities beside the strictly legal ones, and Wendell's assertion that this matter has "nothing to do with Magnepan" strikes me as overstating their innocence. If Brummel had had the speakers at his house that would be one thing. But the speakers were at the factory, were not shipped from the factory in a timely manner, and were apparantly under the control of Steve at the factory. If this was purely Steve's deal independent of the factory that fact was not made clear to me then, nor is it clear to me now. Nor does it seem to make much difference either way. If someone in the factory is dealing obsolete product to the public then maybe the factory should be concerned. This is not "spin," Wendell. These are the facts as represented to me by both Brummel and Steve.8. What do we want, speakers or refund? We would take either, actually, if we could get either in a reasonable time, like by the end of the month for instance. Doesn't seem too much to ask since we've been waiting a year. Does Brummel have my address? Hell I'll post it here if he wants it. Or I can send it to him for the sixth time. Or I'll send it to Magnepan for the second time. Take your pick. If Brummel is the honest man he claims to be we should see something very soon. I'll let you know.
