This is the way I got my FM-3 from auctions_mcbia with a dented face plate. The eBay picture they posted didn't have a dented faceplate; the description didn't mention any dent in the face plate.
You can see the original pictures here:

I provided two sources where they could purchase a used face plate to correct this problem; they told me the damage didn't look bad, that I should pound it out.
Then instead of providing a replacement face plate, they offered me $10. When I pointed out that I bought the unit to gut restore (its a dead unit) and wouldn't restore a unit with a dented face plate, they offered $15 (a replacement face plate from FM Zone is $30).
Since I rejected $15 to buy a replacement face plate, they told me to mail it back to them at my expense, $20. I've rejected spending $20 to return a item they damaged before shipping it to me.
They have also rejected me sending the damaged face plate to them so that they can repair it (pound it out).
According to them, their warranty covers returning defective items to them at the buyers expense. Of course, their warranty doesn't cover items they damage after selling them and then send to the buyer.
It will be interesting to see how eBay deals with this vender, especially since all of the communication I've received indicates the owner hasn't been involved in solving this problem.

Please return the item with the RMA we have already issued. Once we receive the item we will refund you as per our stated warranty policy. http://www.mcbia.com/ebayauctions/warranty.htm Thank you
You are being silly again.
Your warranty does not state the buyer has to pay to return items you damage after you sell it.
It doesn't state that the buyer must pay to return an item if you send the wrong item.
It also does not state that the buyer must pay to return an item they didn't buy.
To further illustrate, if I damage the case, put a dent in it like you did the face plate, or damage the IF cans, you'd balk at me telling you you have to pay to mail it back to me. Likewise, you just say NO if I offered to refund less than the value to repair the damage.

Well. That was an interesting phone call with eBay. According to eBay, if the seller mails the wrong item, if they mail a defective item, and if the seller mails out an item they damage, the buyer has to pay to return the item.
If you buy an item, and they mail you a brick, you have to pay to mail the brick back.
That certainly explains why the seller wouldn't try to replace what they damaged, they don't have to.
Fortunately, this seller, and receiving something a seller damaged is a rarity for me.

Yup, that's the way that it works with eBay. I was once shipped an empty box, eBay and Paypal would do nothing for me unless I shipped the empty box back at my own expense. The clueless seller bought the item at a yard sale and didn't even look inside before listing and selling it. Since I'm in Canada and the seller was in the US, it was not at all worthwhile to return it, so I got ripped off. Completely ridiculous policy.
If I understand eBay correctly, I ship the item back, and eBay issues the refund? The seller gets of without any penalty, except for negative feedback?

No, the seller issues the refund after they receive the item back from you. eBay will not pay for anything, regardless of what happens.
Take care,
Doug
Thanks for the info.
It looks as if I'm still pissed about getting a damaged face plate.
I keep tryin to talk myself out of sending them a brick with a picture of the damaged face plate on it.
Course, I could drop the unit an few times and then mail it back. But, I can't see me damaging any old gear for spite.
Maybe mail the unit with some Javalina crap inside of it with the screws JB welded in place?

My spiteful self reasons that if they don't even have to send what they advertised, I don't have to send back what they sent.
