Yes, although in my case I should have done it quite some time ago. Frankly, until very recently, I was unaware of the scope of the Welborne problems. I attributed the delay to the realities of running a one-man shop and assumed that Ron, certainly a well-known figure, would come through. I never doubted it really.
Now I do and, should Welborne not respond to the BBB inquiry or issue my refund in short order, will be filing a small claims action in the Douglas County Combined Courts. If anyone else is interested in going down this road feel free to contact me and I will forward the forms and a link to the relevant web site.

Even if it seems useless to some people, I think to have done the BBB step is a plus, because of the try to solve the problem by a 3rd-party mediation way.
Then, I have filed a complaint to the ic3.gov which should send it to the right law enforcement agency. For avoiding interferences, I'm waiting news from that procedure before to open another one. But perhaps our roads will meet at a certain point !

I don't know. From my readong of the applicable Rules, only the Defendant, Welborne, needs to live within the state so that the Court can have jurisdiction over him. I would guess that a bilked Canadian could avail himself of Colorado's judicial system.
If I were you I would contact the Court. They cannot provide legal advice, but can answer general questions.
would probably be easier for a Canadian individual who's not a lawyer just to file the suit and then let the defendant do the work by trying to get it dismissed if they can. Usually an out-of-state corporation must qualify to do business to file suits, but no restrictions on individual plaintiffs.
