Justify in more detail why they need to enforce a disclaimer statement about warranty, ex. "Given the high # of 2nd hand users with warrany issues we ask that resale (ebay, Agon, etc.) carries a statement that..., we also found that....,we at Mac care for the..., etc." ...."We would like to stress that no futher request will be imposed on Mac cust.**, and we appreciate your voluntary participation and understading, sincerely: employees of Mac (**, thats where the nifftty lawyer comes in with a tiny pen...)....They should have no business MAKING individual CUSTOMERS carry such statement...which is where the problem lies on some level, and it raises the issue of "where will they stop?" if you give-in to this...Right of owner vs Manufact., it becomes a dispute over principles rather then an EBAY auction, how much right does your money give you w/r respect to that product you purchased (same issue with CD copying, etc..)
As a reseller, i want to have the opportunity to represent my item the same way McDonald represents a hamburger on their bboards ads: as that thing youll never actually see on your plate. I want the chance to state vague virtues and sweeping generalization, the same way Pfizer and Co, do on their TV camp. I want you to think you'll be bundy jumping and mountain clibbing if you sign for my insurance plan. In short i see no reason I, as a reseller, do not have the chance to represent my product with the same "standards" the industry does....then the question becomes where will WE stop, the buyers, when we decide to weed-out the baseless descriptions seen in audio advert's., and make them backup their claim, etc....in the interest of the customer, of course.
