Post-conviction.
When it comes to the sentence one receives then yes, prior convictions can be taken into account.
But they can't be admitted as evidence in order to first obtain a conviction.
This is our system and it goes back to British common law.
At any rate, we don't have the entire story yet. Before anybody hangs the alleged perp, they should take a deep breath and a chill pill.
Because right now this looks to me like just another one of the stupid, senseless everyday acts of violence that just seem to be warp and woof of humanity. Like football fans shooting each other over an argument about, is Alabama better than Texas A&M?
