While he should refund your money right away, I would be a bit patient with him if at all possible. You obviously have the legal rights to a refund but he could make life difficult for you if you give him a hard time.
He was wrong to spend your money prior to you evaluating the piece and closing the transaction. You will have to decide if you want to pursue pressuring him at the risk of him drawing this out and causing you even more grief or be a little patient with him.
