My personal opinion is that patents are marketing and legal weapons ( if you have $$$ ) only.Bingo. When I worked for a large, shall remain nameless computer company, legal would tell all the developers to patent as much software as they could, and would hand out $1000 for patents that got accepted.
"But aren't software patents essentially junk?" we all asked.
"Yes, but other big companies that we cross license with have large patent portfolios, too, and we have to keep up or we'll lose the licensing agreements. Plus, if we have a large portfolio of patents, we can put great legal pressure on small companies that threaten us by finding some patent that they are infringing upon and sue them over it. Even if the patent is essentially baseless, a small company will wither under the legal onslaught from a multi-billion dollar corporation." was the answer, though in much more politely couched language.
Don't big corporations just give you that warm fuzzy feeling all over?
