In support of Steve's argument, here's a link to a little article I wrote a few years ago.I can't comment on whether shunt or series attenuators sound better. However, there is no way that the shunt component can be described as "out of the signal path". The same thing of course applies to switches, pot wipers and anything else in the shunt leg.
