I'm often baffled by what flies and what doesn't in copywrite infringement. Isn't there a statute of limitations? If so, why was John Lee Hooker suing ZZ Top 20 years after the fact for La Grange (ignoring the fact that it was a homage to him in the first place).Also, apparently you have to show that the alleged infringer heard or had reasonable opportunity to have heard the nicked tune. My wife read a case in law school where the Bee-Gees had clearly borrowed a tune from some French artist, but he couldn't show how they may have heard his tune, since it wasn't an English hit. However, Jaques Brel did put the smack down on McKuen for "Seasons in the Sun."
