Next bone to fight over? The Supremem court. Biden is apparently going to establish a 'commission' to look into expansion of the court.
Of course, if HE manages to get 11 on the court to tip the balance, what is to prevent the next guys from The Other Team to go for 13 or 15?
IMO, what is needed is a CONSTITUTIONAL AMENDMENT which mandates the number. Of course, somebody may take a shot at declaring such an amendment UNConstitutional.....which is without merit....

I think a simple 'law' authorizing it will do. Biden MAY push it with an Executive order.
BUT, the word EXECUTIVE implies control over 'The Executive', which is NOT the Judicial OR Legislative branch of the 3 theoretically Co-Equal branches.As it turns out? Number of justices has been a HIGH of 10 and I think 6.....And has changed 4 or 5 times before remaining stable in number since 1869....when It went to nine total.....
Further? It WOULD in all probability be a party line vote.

I didn't say it WOULD HAPPEN. But might be attempted.
And if you READ what I wrote, I also noted that the Court is in the JUDICIAL branch and not subject to Executive Orders......That's the idea behind 3 co-equal branches and 'checks and balances'......
But that MIGHT not prevent an attempt.....Which I don't think could be sustained.Please be patient and READ entire post. I took care of your objection, to which I thoroughly AGREE but noted it is just possible....though a Long Shot.....Vegas wouldn't give you better than 100:1 of this actually happening.

If the Court can jack with the other branches (which they can), then why shouldn't the other branches be able to jack with the Court?
Besides, chances of passing a constitutional amendment is practically nil no matter the subject.
no amendment is needed to change the composition of the Supreme Court
it's size has been modified 7 times via congressional acts
it's been as few as five members and up to ten
of course Acts Of Congress go through the usual procedural steps so ...
I say strike while the iron is hot
dump the filibuster while they're at it
if there's any negotiation involved ensure that it's in bad faith

blocked from a hearing: that was Mitch, the great legislator, breaking with tradition--- and remember Ginsburg's successor? Mitch had no problem putting a replacement vote for her with weeks before the election.
Second: this court is alarmingly, and I mean "alarmingly," making vast numbers of unprecedented "shadow docket" rulings. This is against what Scalia and other conservative SCOTUS's previously have spoken out against.
"All told, the Trump administration sought emergency relief pending appeal 41 times in four years; in contrast, the Bush and Obama administrations together sought such relief eight times in 16 years. And the justices largely acquiesced to the Trump applications, granting 28 in full or in part".
If this isn't "judicial activism, what the heck is?
