Todd, as mentioned I was skeptical as well but nowhere does it say anymore that the DA10 does NOT use ASRC. In fact they removed the claim of no ASRC from the DA10 manual:From DA10 Manual Rev. 3.1:
The LavryBlack DA10 features:- Ultra low jitter modes (without sample rate conversion).
- Included sample rate conversion for non standard rates.

In summary is seems the first version of the DA10 did not use SRC (the one you tried out), but after claims of locking problems with that series seemed to be changed to SRC. Not sure whether the sound between the two versions changed.

I see what you're stating..... I had one of the very first units out of the factory (with the swapped channel markings). There was no semblance whatsoever to the "HF artifacts" of ASRC. The top was a clean as a DAC could be.I didn't realize there was a change to the unit itself. I thought it was a text clarification.
It looks like what happened is you ordered an "original" unit (without ASRC in "normal" modes), and unsuspectingly received a "revised" unit (which *may* now use ASRC). But you chose that unit expressly because it did *not* use ASRC under normal conditions.
Do you notice a "noise" or "haze" in the highs, by chance? Or does the sound seem pristine up there?
If I were you, I'd try to find someone with an earlier DA10, and request to borrow it, to find out if the sound actually did change. Or request Lavry to roll back the "revision" of your unit.
According to Lavry, he found out "how to take advantage of using the sample rate ic while compensating for it. We did upgrade all of the first run units to the current revision."So there should not be two versions out there, just one.
The only problem, again according to Lavry, was that they failed to reflect the engineering revision in their manual description (apparently prepared by their marketing people/person).
Per Lavry, that was what the fuss was about.
As for the sound of the Lavry, mine did NOT have the slightly artificial highs and haze that surrounds some instruments which I have heard from upsampling units. It is not quite as smooth in the highs as my Wavelength Brick NOS DAC. I sold my Lavry a short while ago since I did prefer the Brick anyway. Also, the Brick makes for a much simpler Apple Mac based system.

The impresssion I got from the DIYAudio thread was that one of the revisions must have quietly made the switch to SRC, without any changes to the manual. The change in the manual only came AFTER the DIYAudio thread controversy.
