I could use some advice.

I purchased a new Samsung 85 inch 4K TV with warranty and shipping and insurance from Echo and Optics on June 30, 2014 an online Merchant on EBay. The Total cost for this new TV was $9400. Of this amount, $ 5278.30 came from my Paypal balance and the remainder of $ 4121.70 was from Bill ME LATER” (Now called Paypal credit). The reason I did it this way was because I had a credit in my account with Paypal credit for $1466.02.

I found out that EBay owns Paypal and Paypal credit the hard way…

On 8-4-2014 I received the Samsung 85 inch 4K TV 8-5-2014. In order to open the package to inspect it, I first had to sign for the delivery. Then, the driver and I lifted the box off the TV. The driver and I noticed that the TV screen was severely cracked.
I wanted the driver to take it back, but, after he called his office, he said, that all he could do was write “Concealed Damage” and initial it on the Pro Bill. He said the damaged TV would be up to the Merchant. I have a copy of that Pro Bill.

I immediately notified the Merchant –Shipper, (Echo and Optics), Trucking Company (Freight Quote / Holland) and Paypal/ Paypal credit of the damage. The Merchant had an inspection company take pictures and they wrote a report of the damage.

I filed a dispute then a claim with Paypal that was immediately denied. It seems PayPal will not help because I made 2 payments for one item. Huh? Both were invoiced from the seller and both were Paypal and it was done the same day virtually seconds apart. I tried and tried that argument with Paypal but it went nowhere.

Paypal credit says that unless I send the TV back at my expense to the seller they will not discuss further the Paypal credit portion of the payment. But, if I send this unit back to the Merchant, (I have been quoted up to $1000 for freight charges) and I will still be out the $5278.30 that came from my Paypal balance.

I also paid $120 for a certified Samsung repair center for a repair estimate to replace the screen and that repair is near $6000.

It has now been over a month since I purchased the unit from Echo and Optics he has been paid through the Paypal system and at this point he is not willing to send a replacement unit unless he gets compensated from the trucking company.

So, any helpful advice that will help me?
