Thanks to parental instruction and then Motorcycle Safety training, I apply the following as a matter of survival:

As a pedestrian crossing a street exercising due care, I have learned to look both ways and ALWAYS yield for traffic; I look for crosswalks yet assume the driver can NOT yield (especially when in NYC).

this incident reminds us to take great care when entering a roadway, as litigation has made the choice for some one of fearful "self-preservation" - sad but true.

Oh, to answer the question:
Ban in-use cellphones, (heck, ban all cellphones they are microwaveing our brains away).
Driver education - not more intimidation/punishment crap but earnest driver skill, responsibility and empowerment support - eliminate distracted driving.
