You might be over-estimating the "average" ebay user.

Keep in mind, when you are creating policy for a system that MILLIONS of people are using you can guarantee only:

1. No policy will please everyone
2. Whatever policy you put in place will piss someone off

So, given the task to create policy - my MBA’d dumbass would elect to create a policy applicable to the lowest common denominator.

(MBA not required, a non MBA could solve that one)

Ebay is geared toward power sellers and so are the policies - they are not really concerned with the individual who sells a couple of items every 6 months.

BTW - I am no fan of ebay and am not defending them, however I do believe your assessment is in error.
