It is observations, in particular of regularities, that is fundamental to developing inductive theories. I think you are getting flummoxed by your commitment to a lay connotation of empirical, that is at odds with its use in science. There are multiple words that have more confined meanings as used in science, medicine, law, etc. We are seeking to communicate in a specialized manner and thus not concerned by how others might use the terms. No science that I have ever been involved with ever is concerned with your quackery subtlety. In my opinion, this entire posting is a red herring.
