Some, like where I live, require fire rated back cans for areas servicing a public area. It could be the restriction may be lifted if sprinkler systems are involved and installed.

Also in regards to flush mounted units, please check out the Sonance Symphony series, particularly the 622. It has shockingly good sound and will surpass many 'name' brands.
