192 kbps MP3 is about where I draw the line. Anything below that is unlistenable, and I have stopped patronizing restaurants that played jazz as background music from satellite radio because the sound made me ill.
Apart from noise there is the question of safety. If one concentrates on the music one may be distracted and suffer disaster. Even if one doesn't do anything wrong one may still miss an opportunity to avoid an accident "caused" by an incompetent driver. (I speak from experience.)
