This is awkward for a variety of reasons. Here is the short story:
I arranged to purchase vintage tubes from Penta Labs, so I discussed pricing with the owner and reached an agreement. As the final touches of the deal were put together, things started to fall apart - quickly. The owner insisted the sale be based on As Is with no returns. The owner represented product as new and the pricing reflected that condition - as did our written agreement. Well, the tubes are actually dead - as the owner tested the product prior to shipping.
What bothered me most (and reminded me of why I cannot stand this guy) was the aggressive, brash and unapologetic manner in which the owner handled the matter.
As I was trying to contact the owner to discuss a different opportunity, I did a google search trying to find a phone number that is working (the lines to the 800 number were down) and found that the CEO and owner of Penta Labs was convicted by the United States Department of Justice for fraud - relabeling tubes, representing them as vintage and selling them to government contract providers.
He did his time in jail (1 year) and then house arrest - so he paid his debt to society. He was banned by the DoD, but continues working in the tube industry in the same capacity as when he committed his crime. Now, I'm no Mensa, but it seems that a convicted felon guilty of embezzling should not allowed to work as a bank teller.

I bought some tubes from him awhile ago that were good and as advertised. I believe they were kt99a . In fact I think I went back and got more. I think Penta is one of the major tube retailers and I am just saying that maybe with some tubes you will be taking a chance, especially rare NOS types. And I personally feel that nowadays unless you have a long standing personal buying relationship with the seller, you are taking a chance with any purchase of NOS rare tubes. Man, this sucks. So sorry. I remember getting some mullard e88cc's that were really Tungsrams from him well over a decade ago. A great tube also but not near the price of the Mullard. If you paid with a credit cart try to file a fraud claim to reverse the charge. Best of luck.
Sorry to hear of your experience, but AFAIK, there is no law governing who can set up shop selling, or claiming to sell, anything. Comments like yours on websites like this won't get you your money back but hopefully will help others to avoid the seller, which may eventually put him out of business.
