I recently sold a Benchmark DAC1 USB on Audiogon. The buyer left positive feedback and it seemed that all went well.......until I received the following email from the buyer:
"Hi, Jay:
Houston, we got a problem - actually two.
The unit arrived at my office on 1/18/11 on my day off. I brought it home on 1/19 & inspection of the outside box, inside box & the DAC showed no visible damage. But I did not have a chance to hook it up until this afternoon. There was a loud squeal when I was hooking up the balanced cables & occasionally when I giggle the cables or move the DAC. When I hooked up the power cable, there was a hum, which is decreased quite a bit when I floated the ground, but the hum is still unacceptable.
Would you please refund the total amount via PayPal? I will pay for the return shipping.

I purchased this unit new from Benchmark Media about a year ago. It has sat in my entertainment center where it performed flawlessly for about a year. When it was sold, I placed it back into the box in which it came and sent it to the buyer. There is no way that anything is wrong with said unit and it appears that this guy is just trying to get a free in home trial out of me.
Does this person have any recourse?
Do I have any re coarse?
Even if I wanted to be the perfect gentleman and just refund this guy, there is know way of knowing that I won't get a defective unit back.

Just ask him to send it to Benchmark for checkup. If they find it is ok goes to him, with a bill, if not goes to you, you pay for it, and refund is in order.

So the plot thickens. Today I received this "I am forwarding this email that I originally sent on 1/22. You have not replied, and I hope you have been away and therefore unable to answer. I will give it one more try before I notify Audiogon & PayPal.
I also want to apologize for blaming the Benchmark for the squeal - I discovered two days ago that I had a bad interconnect causing the squeal, NOT the Benchmark. But this still leaves the hum problem that I am unable to solve.
Please reply in the next 48 hours. After the deadline, I will contact Audiogon & Paypal as to how to solve the situation."
So this time I responded and let him know that I did not mention a free in home trial in my listing and I cannot be held responsible for user error. The fact that he was connecting and wiggling wires with both his amp and the DAC on tells me that I'm dealing with a novice.

He can not force money back since it is not e-bay transaction.
And e-mail trail shows that he does not know what he is doing.
Be polite in responses and explain that systems hum due to various reasons, mostly due to ground issues, that, incidently, is quite commonly tied to cables. Offer to lead him through proper system connection.
Ask him to explain his system, including cables, as to send the photos, so that you can help.
Since he had bad cables, he probably still has them.
If he refuses, you have upper hand, resort to my option number one, ask him to send it to manufacturer for checkup.
He refuses, you are of the hook.
Audiogon transaction completed.
He must have fixed it or at least decided that any issues he was having were a result of user error.
Either way. I'm done.

So are you actually the UPS person that delivered the unit, or does Dionne Warwick come over and give you heads up from the Psychic Friends Network?Like Bill, I too was a member of AudioMart and all I can say is that the above statement is so patently wrong that your honesty must be called into question. I wouldn't trust anyone making statements like that.
And yes, the buyer has lots of recourse, both in opening an Audiogon dispute which may cause one of you to lose your Audiogon account, or he can persue recourse through PayPal, or even through the legal system.

I've always tried to follow Walt Bender's rule: if the buyer isn't satisfied, the deal gets undone. I know that puts sellers at a disadvantage to the very few idiots out there who just want to try something, and the many idiots out there who are just idiots. I also know that shipping can cause strange problems; I asked Kyle at Reference Audio Mods about working on my Marantz 8260, and he cautioned that they have seen units fail after shipping, from hairline cracks in the boards, even though the outer packaging was undamaged. And there *are* idiots out there who just don't know what they're doing. I once sold a CAL CD transport and DAC via local pickup. The buyer played them in my home, bought them, then called from his home across town to say it didn't work. Sure 'nuff, it was now junk. I have no idea what he did to it, but I gave him his money back and threw it in the trash. Sometimes it's best to just move on.
For low-end, non-fancy stuff, I'll sell on ebay with "guranteed not DOA; otherwise no returns." For the good stuff I describe it as accurately as I can, and hope I don't run into a problem-buyer more than once every few years or so.
Your buyer sounds like a problem. No one should be hooking up cables, balanced or otherwise, on unknown gear with the power on; if the power is off, he can't be getting a squeal. (And I wonder if that squeal could be coming from his other gear with pin 3 hot connecting to your DAC with pin 2 hot, or home-made cables with pin connections screwed up or something like that...) If it was me, I'd take it back, take my lumps, and move on.

If he paid him thru paypal,there is your protection but DO NOT return the money until you receive the unit.Its no different than if you go to Sears and buy a new TV and then go back to the store and say,it doesn't work right so give me back my money and I will bring back the TV. You know what they will say.
Diversity of opinions on any one technical subject,almost always causes confusion for the listener.
