The shooter, now on 'paid administrative leave' is in DEEP TROUBLE. Eventually I HOPE he is unemployed and unemployable at anything tougher than 'mall cop'.
How can you SHOOT a guy with HANDS UP? All the while, the guy's Autistic Charge sits there playing with his toy truck!

It sounds as if the cop was following procedure by keeping the suspect(s) in his gun sights. The cop may have simply misjudged the situation and/or lost his cool. A lightning quick, three-round burst of gunfire ensued.
Most likely, this act will be ruled as a "negligent", "reckless", or even "accidental" firearm discharge... or all three of these things.

THAN the fun of a CIVIL SUIT follows, for which he WILL be found 100% 'guilty as charged'.
I personally can't see shooting somebody with their HANDS UP, but than I wasn't there.
The video, however, is completely incriminating.

When you go 'civil' many rules no longer apply or are altered.
Proof standard is a little lower, for example.
Also, I'm not certain if double jeopardy applies, either. If he gets charged with some kind of Civil Rights violation and skates can he than be charged AGAIN as a Civil Crime for essentially the SAME ACTS? First trial Criminal and the SECOND as Civil?
I'm not sure OverAll what we Do or Do Not agree on, but hopefully we agree that this guy (the cop) is in a bad way, legally speaking. I'm not optimistic for this guys long-term (like 1 year) Job Prospects, either.

Well PG, hopefully we agree that this guy (the cop) is just plain bad.
No question the guy made some BAD decisions. Now? Does it rise to the level of EVIL? I'm less certain about that.
Should be be or have been chosen to be a cop? Poorly trained? Bad stress reaction?
I simply do not know, but otherwise, Let The Lawsuits Begin.
