When I lived in the Bay Area I would frequent various Fry's stores to buy electronics and computer goodies. It was often very obvious from the packaging that many goods were customer returns that were put back on the shelves for sale. I always made sure whatever I bought from them had no obvious signs of previous ownership. I still got burned a couple times!

You guys are over-stating your case. I've been buying from Fry's for several years - mostly computer stuff - and have never had a problem with any product except for my most recent one. Processors, motherboards, memory, hard drives, monitors, etc. I bought a Sony Vaio and three HP laptops from Best Buy, and in every case, I had done my homework first, and didn't need store staff help, and bought them on sale.
With regard to Best Buy's fine, I wonder if they still came out ahead. Fines can be viewed as a cost of doing business. $4 million fine - no big deal... we made $50 million on those sales. Ca ching.

Fry's DOES sell returned items, but, generally these items have stickers on them indicating that they're returns, or have been previously opened. I've never had any problem at all buying from Fry's - from blu-ray discs to ethernet cables to hard drives to big screen TV's.
If it looks like it's been opened, steer clear.
