they would move on to something even more FABULOUS (yes, that was said with sarcasm) before the other companies had a chance to market a copy.
When companies start suing each other over stuff like this you know the well is starting to run dry.
Oh, what will we do now ...?

How is Apple a villain for defending their R&D and hard work from an Asian copy cat ?

Since you do, why don't you elaborate rather than resort to your habitual hit and run one liners?

a statement of fact, not an explanation of what I mean.
I agree with you. If AbeCollins had an in depth understanding of the issues in this dispute, hints of his understanding would have appeared in his posts.
I've been involved in a bunch of patent disputes over the past dozen years as expert witness/consultant, so I know the magnitude of knowledge and effort required to understand these disputes. It can not be gleaned from reading the trade press.

I never claimed 100% understanding of the disputes between Apple / Samsung but the high level summary is readily available in the regular press. It is not rocket science. Unless you and fmak somehow have access to the internal documents and attorneys battling this case, I would contend that neither of you have more knowledge of the case than anyone else here the Asylum.

That's the point. We know what we don't know, and hence we know enough not to jump to premature conclusions.
As to the press, throughout my entire lifetime, in every single case on any subject where I had inside knowledge of a situation the press got the facts wrong. They are not in the business of "the truth" they are in the business of taking money from subscribers and advertisers. This requires publishing in a timely fashion without adequate investigation and selecting and editing content to meet business goals. The attorneys on both sides of these disputes are doing their best to position their case with the press, making matters worse.
If I were interested in this I would start with reading the patent(s) involved and the associated product marketing literature. In most cases the press haven't the ability or time to have done this. How about you?

Not to hijack the thread, but this is almost exactly like Senate majority leader Harry Reid demanding that Mitt Romney release prior year tax returns that he isn't required by law to release. My understanding is that Romney has done everthing required. Yup... media hyping up a story started by an opponent. This is why I watch NBC only so I know what drivel they're spouting today.
People can ask for whatever they want, and go on fishing expeditions, and thereby imply some sort of wrong-doing, but that doesn't mean that a person or company has done anything wrong. It's all about the implication and the image that an opposing party wishes to paint.
"Romney killed my wife." Oh, please. Where is the Government in regulating such BS?

The patent information has been posted and I have indeed read some of it. However, I do not claim to completely understand it.

Copying a competitor's product w/o investing your own time and money in R&D is a cheap shot way to gain on your competition.

So claiming it's a 'cheap shot' is guessing.
What's more the market thinks that Samsung's nailed it.
What better things could Apple do with the money?
Leap ahead.
Get OVER it Abe. Nothing we do or say here can affect the outcome.

I have nothing to 'get over' Timbo. I find the dispute between Apple and Samsung interesting to follow. Much of the public does too.

Say Apple is spending X-amount of dollars for this case. If adding the same amount to their R&D for future products could leap-frog them ahead of the current i-product theme why not do it? This case could drag out for a long time and end up costing 10's if not 100's of millions, with the end result being what actually? Perhaps a slight change in Samsung's products to move it away from the iProduct, perhaps a fine for Samsung or both. Either way its not likely to make a big dent in Samsungs total budget or overall product line.
From a consumers stand point this is all advertising for Samsung. People who previously never noticed or even looked at Samsungs product might now take a closer look and see just how similar it is to Apple in looks and function and is actually better than Apple in terms of upgradablity. You can upgrade a Android OS but you are stuck with iProducts.
Fact is, everyone likes an underdog. And everyone looks to see the big dominant corporation take a hit. Many people don't like Apple and Microsoft for that matter simply because of their dominance and size. And with Apple, its heavy handed and close-ended approach to its product.
Henry Ford kept getting sued by an organization called the Association of Licensed Automobile Manufacturers (ALAM) who possessed the "Selden patent" (1898) on the automobile.
They were simply trying to limit the field of competitors with the typical public spirited nonsense about protecting the public from the upstarts. Why does this seem to work so often?
They were an organization ahead of their time. Innovation in the US has given way to patent battles in front of juries who have little idea what is being discussed.
If you have any desire to read about the details of this I googled and found this article in a magazine I have never heard of but reading through it it seems to be as I remember the story. http://www.thefreemanonline.org/features/how-henry-ford-zapped-a-licensing-monopoly/
The patent office has been much too lax with patents to the detriment of the "customers". Allowing devices that look much like things you have seen all of your life, but with a little twist, become intellectual property which is then used as a weapon against smaller firms making stuff that looks similar; even if they have enhanced the "twist" into something much better than the patented thing, but they are then sued for their transgression with the hope that the bullying will be effective.
Exactly as you said the money spent on lawsuits would be much better spent on innovation. But the key is there are more lawyers than engineers in the US and these folks must find something to do.
This problem extends throughout every discipline. Especially obnoxious in the drug world ...
Stealing? Some would call it an evolutionary process that draconian legal decrees would strangle.
I'm not sure how many people have never considered Samsung or its products given that they sell slightly more smart phones than Apple already globally.
Samsung however makes a lot less profit on theirs.
Less profit is fine when you sale more units. Its all about market share.
Apple is like Porsche, Samsung is like Hyundai.....simply there are more middle income consumers in the world so Samsung has the edge.

Last thing I heard Apple and Samsung together have over 50% of the market in smart phones with Samsung having a slight the edge on Apple in sales.
Oddly enough most of my friends have Apple computers but none of them own an iphone while 2 or 3 own a Samsung or HTC.
"Less profit is fine when you sale more units. Its all about market share."
Tell that to Dell and HP !! Both have huge market share and both are in the shitter trying to keep their companies alive.
I would rather have a small but very profitable market share while providing a premium product and experience to my customers.

That's exactly one of the points being made in the a law suit.
"Fact is, everyone likes an underdog. And everyone looks to see the big dominant corporation take a hit. Many people don't like Apple and Microsoft for that matter simply because of their dominance and size."
And Samsung isn't an industry titan in it's own right? In terms of market cap, it's South Korea's largest company at ~$350 billion. That's bigger than Microsoft, HP, and Dell - COMBINED !

That's why this whole thing is no big deal for Samsung....its a calculated risk.

"That's why this whole thing is no big deal for Samsung....its a calculated risk."
So copying a competitor's product is OK if you're a large company that decided to take a calculated risk of being sued?
![]()
Most large Companies get very large by being crooked you only have to look at the crooked Banks etc. As for Apple , I prefer Samsung mainly because of its far better Blue-tooth. Samsung is on a roll especially for TV where previously Sony was supreme.
On the other hand doesn't it make sense for a company to protect it's IP and investment from copy cats?
I believe the iPhone 5 is rumored to be out in a month or so, and a smaller less expensive iPad is also the works.
