What legal recourse can I take (if any),with a person who recieved $750 from me for an amp that I never recieved?I have the fedex reciept that he took the envelope ,an e mail from him stating that the amp was broke and that he would send me the money back instead of the amp,and a uspo money order reciept.I live in Chicago and he lives in Staten Island.Any suggestions would be appreciated, for I have done many transactions over the web and have never been burned before. He will not call me back or answer my emails. This was not an audiogon trans or ebay but one Asylum member to another.
What's the timeline so far? Sometimes people can over react when they don't get a response within an hour or so of leaving a phone message or sending an email. I'd be uncomfortable waiting for a day or two or even longer for a response - however there could be a good reason for a delay in respnse.
Give me rhythm or give me death!
Hello...he received the money on October 27th.His last e mail was a week ago and I have left him 2 phone numbers and a request to either email me or call .No reply in 6 days.I would love for him to post his side of the story or better yet send me my money...in a day or two I will post his email address.
I would call the Staten Island District Attorney's office and the Postal Inspector for NYC and indicate to them what has happened to you....this is clearly illegal and the perpetrator should be prosecuted to the full extent of the law. That kind of behavior is disgusting and is no different than someone taking your wallet at gunpoint on the street.
Good luck and please keep us posted.
Why don't you tell us the miscreant's moniker and/or real name so we can all hate him in unison. He should die and rot in hell for this!
'die and rot in hell'
Pretty harsh coming from someone in your alledged profession. Especially after just hearing one side of the story.

We only have one side of the story, and as DonT said, no timeline.
Die and rot in hell is a pretty strong prescription based on limited info.

but based on the story as told the "sellers" behavior has been deplorable!
I do suppose it would be wiser to withhold final sentence until the "defendant" has a chance to present his side.
Point well taken, thanks!
Ask Bruce, He is the legal consulant here. I feel certain some sort of complience can be arranged.
It will interesting to know the outcome, but not necessarly need be public.
