It's well proven that frequencies beyond either end of the 'audible' spectrum effect us and our perception, and what exactly do we call 'distortion'?
Even the best designers of high-end equipment realise the limitations of what we can and cannot measure, and I wonder what the background of the ASA agency 'expert' is?
I can quote all the objective arguments you and others make - it's simplistic and rarely based on actual experience which unfortunately is discounted as subjective/anecdotal.
