Steve, here in Canada if someone can show that they had the idea first, the patent that was applied for can be "struck down".
When applying for a patent you can not make your patent public until you apply. So if I for example had the idea out there publicly -they then in theory, copied my idea.
Most people think that it comes down to who applies first, and the "Patent" selling feature sure sucks a few people into it.
Do most people know, that to defend a patent would cost that company a minimum of $250,000 (in Canada at least!).
Most companies are not able to defend their patent(you just have to change a few points on the patent), but they use it to try and scare off individuals.
