eBay/paypal buyers prtection...are the ddays over

I hope this is the right forum, it seems like inmates often have a vent about eBay here. n fact I had formed an opinon that paypal was v ery protetive of the buyer, from reading some posts here.
I bought a pair of quad esl63's (I hope the link below works) on eBay here is Australia. They are described as one makes a noise and one works well, and at least one needs a repair. When I got them, they were both stuffed= panels had deglued.I have been arging with the seller for some time and opened a payal dispute yesterday. I argued that "one speaker works well" was clearly stated, but paypal has accepted the seller's argument that at least one speaker needs a repair as grounds to let her off.
I am pretty didgusted and it looks like this is their final decision. I would be interested to hear from anyone else who has a problem like this

Why don't you pop down to visit Ms Juicy Lucy with the items and confront her(?)
and try and sort a resolution for payment of repair split possibly then.

When working they are fine speakers--Good Luck

...but since ePay seems to be content with its decision, some feedback might be in order over there (I say this as I didn't see ANY negatives there)...

You have ZERO protection with eBay or PayPal. Don't bother reading the rules they are meaningless. The individual at eBay/PayPal you are dealing with holds all the cards. It is their personal decision that is binding and the rules mean nothing.

I had a similar situation with eBay earlier this year. Sold a mint pair of Tannoy drivers. The buyer trashed the things then claimed they were defective. He did absolutely nothing that eBay asked him to do to prove the drivers were defective. I did everything they asked me to do and clearly demonstrated the drivers were fine. Guess who got a box full of junk back? Guess who won the dispute?

You have ZERO legal recourse. Binding arbitration is all you have the final defense of crook's and and thieves'.

The bottom line with eBay is you should never spend more money than you are willing to loose.

Unfortunately in your particular situation the outcome was predictable.

That PayPal protects the buyers at the expense of the sellers. However, I can tell you from personal experience that PP is not above absolutely boning a buyer over a disputed purchase. I ordered/paid for a Seiko watch and received an empty box. Despite the fact that this was confirmed by a notarized statement from my postman, PP told me "tough shit" and denied my claim.

I will never again use PP for any purchases, the risk is simply not worth it...

The SELLER has ZERO (or, almost zero) protection.

The buyer, on the other hand, is OVER protected; almost to the point of having carte blanche to defraud & rip off the seller.

That's one of many reasons I still buy quite a few things on ebay, but haven't bothered selling in over a year.

Both parties have little protection but the seller has the weaker position for sure.

Bottom line is one takes a lot of risk buying or selling on eBay. It is like gambling. Only play with what you can afford to loose.

I have always heard eBay and Paypal were slanted to the buyer. I've yet to be hosed either way.

...eBay/PayPal has just increased the time a buyer can file a dispute from 45 days to 180 days. That's absurd. I can imagine folks enjoying their purchase for five months and then getting in a jam for money and filing a dispute.

...so you can try to charge the seller back. This has worked for me. If you pay from your PayPal balance, then PayPal gets the last say.

I do not maintain any balance in my PayPal account. I have purchased quite a few items through e-bay via PayPal but always use a credit card. If I have to dispute something I file a dispute with my credit card company at the same time I file one with PayPal. This has always worked for me in the past for the several times I have had to resort to disputing my purchase.

Unless you paid for the Quads by credit card I'm afraid you might be SOL.

I have had a lot of experience with ebay/paypal without any problems -- for my vintage razor and shaving tackle hobby. The most expensive item I have bought was $50.

The system works well for me at this modest level. I would not consider it for buying or selling audio gear, or anything else of a value that I considered a significant risk. It is an inherently arbitrary and risky business.

Yes, if buying, must use credit card or something you can get your bank to help you chargeback/dispute. If selling, transfer the funds to an offline account (e.g. one not attached to Paypal) before shipping. Paypal may try to recover funds if you get shafted by the buyer but they will fail if you've already moved the money. It will require you to abandon that account since it will have a negative balance, but at least you don't get screwed out of the funds, and you can always start another paypal account if need be.

and I have fouynd out the issue- Paypal won't cover a pickup item once its picked up.
wowsers! that's a rule I had not encountered before

... eBay doesn't give you a "get of jail free" card for "caveat emptor"

Good luck with your repair - they are fantastic speakers when they work!
