Audiogon terms - one last post

The folks at Audiogon saw my Sept 25, post here and responded to me personally by email. They handled my stated concerns by further explaining their intent "to create a better place for both buyers and sellers," and by modifying portions of their agreement language for purposes of clarity.

Therefore, I am posting one last time on this issue, not for further opinions or discussion, but in fairness to Audiogon for the concern they showed in their responses to me, the action they took in changing and clarifying their agreement terms, and to share their responses with those here who are interested. I appreciate their proactive response and willingness to make improvements and I will agree to their terms and continue to be an active participant both there and here.

Below are excerpts from Audiogon's two emails to me;

"Additionally, the terms and conditions have been updated to reflect that a transaction fee is charged based on SOLD price, not list price."

"In regards to them (transaction fees) being non-refundable yes they are not refundable after a sale. However, in the unfortunate situation that we are notified with proof that either the buyer or seller has backed out then the fees will be reversed and the item will be re-listed. The backed out party will be assessed a buyer back out fee of $19 and will have the right to leave negative feedback for that user that backed out. We also have a policy that tracks the number of instances a user has backed out so we don’t keep buyers or sellers on our site that are not ethical."

"In regards to asking that the item only be listed on Audiogon and that a fee will be assessed if it is sold at another venue, I see that is confusing. Unless your item at Audiogon either has (1) an accepted offer, (2) buy it now (3) is marked sold or (4) is reported sold by a member a transaction fee for that item is not assessed by Audiogon. We have removed that part of the terms and conditions as it was not our intention for it to be perceived that way. If your item is listed on multiple sites, we ask that you close your listing on Audiogon if it is sold somewhere else."

"As far as your comments about a credit card on file and billing dispute charges, yes you can dispute your charges with us if something is inaccurate, we simply ask you do it within 30 days of the charge. In fact please dispute it with us first before disputing with your credit card company."
